Termination Procedures

A.

When, in accordance with the College's policies, it is necessary to propose dismissal of an employee, the employee’s supervisor and their supervisor shall consult with the Executive Director of Employee Relations (or designee), to determine whether dismissal is warranted and appropriate. If the employee in question is a direct report of a Unit Vice President, the decision for termination will be made by the Unit Vice President in consultation of the President and Executive Director of Employee Relations (or designee).

If it is determined that dismissal is warranted and appropriate, notice of the pending termination shall be given to the Unit Vice President and Chief Human Resources Officer (or designee), and then the supervisor and the Executive Director of Employee Relations (or designee), will meet with the employee to explain the reasons for termination. The last date of employment will be the date notice is given or sent to the employee.

C.

When an employee has access to institutional Due Process, as defined in Policy, within five weekdays (including holidays) after the date of the termination notice, the employee may contact the Unit Vice President (or designee) to appeal the termination decision and file a Notice of Due Process. The Notice of Due Process shall include all of the reasons the employee is challenging the termination and shall provide supporting information. The Unit Vice President and the Chief Human Resources Officer (or designee) shall review the decision and may seek additional information, as needed. The Unit Vice President and Chief Human Resources Officer (or designee) shall then determine to uphold the termination decision, overturn it, or may enact any other appropriate remedy. In the event the terminated employee is a direct report of the Unit Vice President, the Notice of Due Process should go to the Chief Human Resources Officer and review should be made by the Chief Human Resources Officer and the President.

D.

If the employee files a Notice of Due Process within five weekdays from their last date of employment (the date they were notified about the termination), the Unit Vice President and Chief Human Resources Officer (or designee) will complete their review and given notice of their decision upon completion. If the five weekday time period passes and the employee has not submitted a Notice of Due Process to the Unit Vice President and Chief Human Resources Officer (or designee), the termination decision shall be affirmed.
