7.00 Conduct of Students
As members of the larger community, students are entitled to all rights and protection accorded them by the laws of the community. As members of the academic community, students are subject to the obligations of the College community as well as federal, state, and local laws. The Central Piedmont Student Code of Conduct, including Students' Rights and Responsibilities and Disciplinary Procedures, is published online in the Central Piedmont Student Handbook. However, in accordance with 7.20 Sexual Misconduct Policy, some forms of harassment may also violate the College’s policy against Sexual Misconduct under Title IX. When a report of harassment is received, the Title IX coordinator will determine whether it shall proceed under this policy or the Sexual Misconduct Policies and Procedures.
Students must abide by all the provisions of North Carolina General Statute 14-269.2 Weapons on Campus or Other Educational Property.
A. College premises – any property in use by the College, including property that is leased, owned, used for College functions, or used by the College in the conduct of any of its courses.
B. Weapons – any object, visible or concealed, that is or could be used to threaten, intimidate, injure, or kill another person. Examples of such weapons include, but are not limited to, guns, rifles, pistols, BB guns, stun guns, air rifles, air pistols, other types of firearms, explosives, metallic knuckles, clubs, batons, and knives or other blades.
C. Student – any person enrolled in any course offered by the College at any location, whether it is credit or non-credit. These policies, therefore, apply to any student for any semester during which that student is enrolled or during which an activity in question transpired.
D. Administrative meeting – an informal meeting between a student and the Dean of Student Life and Service-Learning (or designee) to discuss an alleged violation of the Student Code of Conduct. An administrative meeting does not result in a sanction; however, following the administrative meeting, the Dean of Student Life and Service-Learning (or designee) may determine that the situation warrants a disciplinary hearing.
E. Disciplinary hearing – a formal hearing between a student and the Dean of Student Life and Service-Learning (or designee) during which due process will be followed. A disciplinary hearing may result in one or more sanctions, up to and including suspension or expulsion.
A. General Standards of Conduct
Students shall obey the law, show respect for properly constituted authority, perform contractual obligations, show regard for the property of other persons and the College, maintain absolute integrity and high standards of individual honor in scholastic work, and observe high standards of behavior that are appropriate for a democratic educational environment in which the rights of others are respected.
B. Illegal Activities
Students shall not engage in illegal activities on College premises. Such activities include, but are not limited to, theft; gambling; the possession of weapons; and the possession, consumption, or distribution of illegal drugs or alcoholic beverages that are regulated by state statute. Violators will be prosecuted by civil authorities and may additionally incur sanctions by the College.
C. Alcohol and Illegal Drugs
Students shall not manufacture, distribute, dispense, possess, use, or be under the influence of illegal drugs or alcohol. This policy is further regulated by 7.01 Drug-Free College Policy.
D. Possession of Firearms
Students who are on College premises or attending functions sponsored by the College are strictly prohibited from having weapons in their possession except as required for any course for which they are registered.
A firearm is permissible on College premises only under all of the following limited circumstances:
1. The firearm is a handgun; and
2. The individual has a valid concealed handgun permit or is exempt from the law requiring a permit; and
3. The handgun remains either in a closed compartment or container within the individual's locked vehicle or a locked container securely affixed to the individual's locked vehicle; and
4. The vehicle is only unlocked when the individual is entering or exiting the vehicle; and
5. The handgun remains in the closed compartment at all times.
Handguns are NOT permitted to be carried on College premises at any time.
Any student who has reason to believe these regulations are being or have been violated must immediately report the matter to College Security at x6911 or 704-330-6911.
Any student who violates these regulations, or who fails to report reasonable suspicion of any violation, will be subject to disciplinary action up to and including being banned from campus, suspension, or expulsion.
Duly sworn law enforcement officers and deputy sheriffs acting in the discharge of their official duties as well as others mentioned specifically in North Carolina General Statutes 14-269.2 are exempted.
IV. Disciplinary Sanctions
Illegal activities on or off College premises or failure to meet standards of conduct acceptable to the College while on its premises may result in appropriate sanctions, including disciplinary suspension and expulsion.
V. Due Process and Disciplinary Procedures
The procedure stated below will be followed when disciplinary action against a student is initiated. Student organizations may also be disciplined using these same procedures.
A. Within seven working days after a complaint is received and evaluated, the Dean of Student Life and Service-Learning (or designee) may inform the student of the complaint against him/her in writing, as deemed necessary.
B. The student will be advised of the date, time, and location of the administrative meeting or disciplinary hearing in which the complaint will be presented.
C. The Dean of Student Life and Service-Learning (or designee) may invoke interim suspension and temporarily suspend a student until the disciplinary process can be completed. An interim suspension may be lifted at any step in the procedure by the Dean of Student Life and Service-Learning (or designee).
D. The complaint will be described and examined at the administrative meeting or disciplinary hearing between the student and the Dean of Student Life and Service-Learning (or designee). An accused student does not have the right to representation or to use any recording device at a hearing.
E. The Dean of Student Life and Service-Learning (or designee) will have five working days following the hearing to present a written decision to the student.
F. The Dean of Student Life and Service-Learning (or designee) will notify all appropriate College offices regarding actions they need to take in response to the decision about the student and will notify College Security if a student is suspended or expelled from the College.
G. A student who wishes to appeal the decision has five working days following receipt of the written decision to request an appeal hearing. The process for conducting an appeal hearing is outlined in Section V of the Student Code of Conduct.
H. Following an appeal hearing, the decision of the Dean of Student Life and Service-Learning (or designee) may be appealed to the Vice President for Enrollment and Student Services, whose decision will be final. This final appeal will be conducted only if the student shows evidence that the College violated its own procedures in conducting the appeal hearing.
I. A student who is suspended shall apply to the Dean of Student Life and Service-Learning (or designee) for readmission to the College.
J. A student who is expelled shall apply to the Vice President for Enrollment and Student Services for readmission to the College.
