4.19 Military Leave

I. Rule

In compliance with North Carolina General Statute 127A-116, Section 02D.0104 of Chapter 23 of the North Carolina Administrative Code, and the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), leave shall be granted to all employees of Central Piedmont Community College for certain periods of service in the Uniformed Services. Employees of the College or applicants for employment shall not be discriminated against because of their membership, application for membership, performance of service, application for service, or obligation for service in the Uniformed Services.  Part-time employees are not eligible for military leave benefits, but are covered under the reinstatement regulations.

Central Piedmont Community College administers the rules and regulations of military leave in accordance with the Military Leave policy in the State Personnel Manual. Please refer to the State Personnel Manual for details.

II. Procedure

A full-time employee, when required to perform short-term military training duty as a member of a reserve or guard component of the Armed Forces, receives time off from work with pay under the conditions specified in Section 2D.0104 of Chapter 23 of the North Carolina Administrative Code.

A. Upon receipt of the notice of training duty, the employee will inform the immediate administrator.

B. The immediate administrator will issue a memorandum authorizing the leave.

C. The immediate administrator will record the period of the leave on the leave accounting form.
